The service provider of the services offered on this website is SIA “XRoom.lv”, registration No. 42103109416, VAT No. LV42103109416, legal address: Spilves iela 20, Spilve, Babītes pag., Mārupes nov., LV-2101, bank account LV36UNLA0055005102233, email: info@xroom.lv, phone: +371 22066566, hereinafter referred to as the Service Provider, on the one hand, and the person placing an order on the website, hereinafter referred to as the Customer, on the other hand, conclude the following distance contract.
1. Subject of the Contract
1.1 The Service Provider undertakes to provide the Customer with services offered on the website, including:
• gift cards for visiting XRoom.lv escape rooms;
• prepayment and reservations for visiting XRoom.lv escape rooms at a selected date and time.
1.2 This contract applies to all orders placed on the Service Provider’s website.
1.3 The service is an entertainment service provided at a specific date and time after the reservation is made.
2. Ordering and Payment Procedure
2.1 The Customer places an order on the website by selecting the relevant service and completing the payment.
2.2 By placing an order, the Customer confirms that they have read and agree to the terms of this distance contract.
2.3 Payment for services can be made using the payment methods available on the website or by paying the invoice issued by the Service Provider.
2.4 The invoice is issued electronically and is valid without a signature.
2.5 The service or reservation is considered confirmed once the Service Provider has received the payment or prepayment.
2.6 By completing the payment for the service or reservation, the Customer confirms that they have read and accepted the terms of this distance contract, including the cancellation, rescheduling and refund policy.
3. Gift Card Terms
3.1 A gift card is a prepayment confirmation that allows its holder to use services offered by SIA “XRoom.lv”, namely visiting escape rooms.
3.2 Gift cards can be used when making a reservation for XRoom.lv escape rooms through the Service Provider’s website or another reservation method provided by the Service Provider.
3.3 A gift card is valid for 6 (six) months from the date of purchase.
3.4 After the expiration date the gift card becomes invalid and any unused balance is not refunded.
3.5 Gift cards cannot be exchanged for cash.
3.6 If the reserved service price exceeds the value of the gift card, the Customer must pay the difference.
3.7 If the reserved service price is lower than the gift card value, the difference is not paid out in cash and is not transferred to other reservations. A gift card may be used for one reservation only and is considered fully used after that reservation.
3.8 Lost, stolen or damaged gift cards are not restored or compensated.
3.9 Gift cards may only be used to pay for services provided by the Service Provider.
3.10 In exceptional cases the Service Provider may consider extending the validity period of a gift card upon a written request from the Customer. Such an extension may be provided only in rare cases at the discretion of the Service Provider and may be a paid service. The Service Provider is not obligated to grant such an extension.
4. Reservation and Prepayment
4.1 By making a reservation for a specific date and time, the Customer reserves the right to receive the service at the selected time.
4.2 If a reservation requires prepayment, it forms part of the total service price.
4.3 A reservation is considered confirmed only after payment or prepayment is received.
4.4 The Customer is responsible for providing correct contact information when making a reservation.
5. Cancellation or Rescheduling
5.1 If a reservation is cancelled no later than 48 hours before the reserved time, the Service Provider may at its discretion offer rescheduling to another date or time.
5.2 If the reservation is cancelled less than 48 hours before the reserved time, the prepayment will not be refunded.
5.3 If the Service Provider cannot provide the service at the reserved time due to objective reasons, the Customer will be offered a rescheduled reservation or a refund.
5.4 If the reservation was made using a gift card or prepayment and the Customer or participants do not arrive at the reserved time, the reservation is considered used and the Service Provider is not obligated to refund the payment or restore the gift card.
6. Service Provision
6.1 The service is provided at the location, date and time specified in the reservation.
6.2 The Customer and participants must arrive on time.
6.3 If the Customer or participants arrive late, the Service Provider has the right to shorten the duration of the service.
7. Personal Data Processing
7.1 By placing an order, the Customer agrees that the personal data provided may be used for order processing, reservation administration and communication with the Customer.
7.2 Personal data is processed in accordance with Latvian and European Union data protection regulations.
8. Final Provisions
8.1 This contract enters into force at the moment the Customer places an order on the website.
8.2 In matters not covered by this contract, the parties shall follow the laws of the Republic of Latvia.
8.3 Disputes between the Customer and the Service Provider shall first be resolved through negotiations.
8.4 The Customer agrees that in case of a dispute they may contact the Consumer Rights Protection Centre of Latvia.
8.5 If the dispute cannot be resolved through negotiations, it shall be settled in accordance with the laws of the Republic of Latvia.
